1. Placing an order

When you place an order on our site, it is not a legally binding agreement. This means we still have the option to cancel your order due to typing errors, technical problems, delivery failures or similar circumstances. We only accept your order when we ship the goods from our warehouse. An invoice for the order is sent at the same time.

When you place an order on our website, our system will generate an automatic email with an overview of what you have ordered. This is merely an electronic receipt confirming that your order has been received. The automatically generated email is not a legally binding order confirmation. The agreement only becomes binding when you receive an email stating that the goods have been shipped from our warehouse.

Please note that when you approve the payment, the money is reserved on your account. The money is only deducted from your account once you receive an order confirmation and the item(s) have been shipped from our warehouse.

2. Payment

When paying by card, the payment will be reserved on your account in accordance with the terms of your card, until we either capture or decline the payment.

The amount is charged when the goods are shipped.

All prices are in Danish kroner (DKK).

If several items are ordered in one order and one or more of the items cannot be delivered immediately, we will only charge the payment for that item or those items when they are shipped.

3. Delivery

We offer delivery of goods to addresses in Denmark.

See the delivery time for each product on the individual product page in the webshop.

4. Right of withdrawal

You can withdraw your purchase within 14 days without giving any reason. If you have bought several items in one order, you can choose to withdraw from the purchase of some or all of the items. We do not refund delivery costs in the case of partial withdrawal.

The withdrawal period expires 14 days after the day on which you, or a person you have chosen to receive the goods (other than the carrier), take physical possession of the goods.

If you have ordered several items in one order and we cannot deliver the items at the same time, the withdrawal period runs from the day you take physical possession of the last item.

If the deadline expires on a public holiday, a Saturday, Constitution Day, Christmas Eve or New Year’s Eve, the deadline is extended to the following business day.

4.1. Exceptions to the right of withdrawal

There is no right of withdrawal for goods that are made to your specifications or that have a clearly personal character, such as individually customised Action-cards, or sets of Action-cards made specifically to your request.

4.2. How to withdraw

You withdraw from your purchase by giving us clear notice that you wish to withdraw. For example, you can send an email to contact [at] action-cards [dot] com or a letter to Copenhagen Risk & Safety Group ApS, Askevænget 47, 3. Th, 2830 Virum, stating that you are withdrawing from your purchase.

You cannot withdraw by refusing to accept the goods or by failing to collect them without also notifying us that you are withdrawing.

The withdrawal deadline is met if you send your notice of withdrawal before the withdrawal period has expired.

4.3. Returning the goods and return costs

If you have withdrawn from the purchase of an item, you must send or hand over the item to Copenhagen Risk & Safety Group ApS, Askevænget 47, 3. Th, 2830 Virum, without undue delay and no later than 14 days after you have notified us that you wish to withdraw from your purchase. The deadline is met if you return the goods before the 14 days have expired. You, as the customer, must pay the return shipping costs yourself.

4.4. Refund upon withdrawal

When you withdraw, we will refund the payments received from you that relate to the order, or the part of the order, that you have chosen to withdraw from. We will also refund the ordinary standard shipping you paid when ordering, but not any additional costs if you chose a more expensive delivery method than our cheapest standard delivery.

If you have bought several items in one order and only withdraw from part of your purchase, we do not refund the shipping costs.

We will refund the amount no later than 14 days after we have received your notice of withdrawal. However, we may withhold the refund until we have received the goods, or until you have documented that you have sent them back.

The refund is made using the same means of payment that you used for the purchase.

4.5. Condition of the goods and packaging upon return

You are only liable for any reduction in the value of the goods that results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. You may normally examine and try out the goods in the same way as you could in a physical shop.

You must return the goods in the original packaging. The packaging may be opened, but must not be destroyed. If the packaging is missing or damaged, this may constitute a reduction in value for which you are liable.

You should also make sure that the goods are properly packed when you return them. You bear the risk for the package/goods until we receive them. Therefore, keep the postal receipt and any track and trace number.

5. Complaints about defects

The Danish Sale of Goods Act (Købeloven) applies if you buy a good, a digital service or digital content and there is a defect in what you have bought. A defect is, for example, a material or manufacturing fault or incorrect information about what you have bought. By contrast, normal wear and tear or self-inflicted damage is not a defect.

You can complain about defects in the goods or service for up to 2 years from the time of delivery. You can make a complaint by contacting our customer service at contact [at] action-cards [dot] com. If you wish to complain about an item, you must do so within a reasonable time after you have discovered the defect. In the case of shipping damage, we ask you in any event to notify us as soon as possible. If you contact us within 2 months of discovering the defect, your complaint will always be considered timely. If the complaint is justified, we will refund your reasonable and necessary shipping costs. Therefore, keep your receipt.

We ask you to state as precisely as possible what the problem is and, if possible, to submit photos of the defect. If we need to examine the item, it must be sent to Copenhagen Risk & Safety Group ApS, Askevænget 47, 3. Th, 2830 Virum. The item must be sent in proper packaging.

6. Privacy policy

When you shop at Action-cards.com, we need the following information about you in order to enter into an agreement with you:

  • Name
  • Address
  • Telephone number
  • Email address
  • Delivery preferences
  • Payment method
  • Information about the IP address from which the purchase was made
  • Information about what you have purchased and possibly returned
  • Any information about enquiries or complaints

We use your information to process and deliver your order, to communicate with you about the purchase and to fulfil our bookkeeping obligations. We only pass on information to third parties where this is necessary to complete the purchase, for example the freight carrier and payment provider. Processing is carried out in accordance with the applicable rules in our privacy policy. There you can read more about how we process your information, when it is deleted, and what rights you have as a data subject.

7. Force majeure and limitation of liability

We are not liable for failure or delay in performing the agreement if it is due to circumstances beyond our control which we could not reasonably have foreseen or prevented, for example strikes, war, natural disasters, government intervention, fire, widespread power outages or breakdowns at carriers and suppliers.

We will inform you as soon as possible if force majeure affects your order. If we cannot deliver within a reasonable time, either party may terminate the agreement and you will receive a refund.

Nothing in these terms limits your mandatory rights as a consumer. Our liability for damages follows the general rules of Danish law.

8. Complaint options

If you are dissatisfied with your purchase, please contact us first at contact [at] action-cards [dot] com so that we can try to resolve the matter.

If we cannot reach an agreement, you as a consumer can lodge a complaint with Nævnenes Hus, Mæglingsteamet for Forbrugerklager (the Mediation Team for Consumer Complaints), Toldboden 2, 8800 Viborg, via https://kpo.naevneneshus.dk/. The Mediation Team will try to resolve the dispute through mediation, and if no solution is found, you can bring the complaint before the Consumer Complaints Board (Forbrugerklagenævnet).

If you live in another EU country, you can also contact your country’s consumer organisation.

9. Governing law and business customers

The agreement is governed by Danish law. As a consumer, you retain the mandatory consumer protection rules of your country of residence. Disputes may be brought before the ordinary courts.

Business customers do not have a right of withdrawal under section 4. The complaint period for business customers is 2 years, and complaints must be made without undue delay after the defect is discovered or should have been discovered. For business customers, prices may be stated excluding VAT.
